CPNI Disclosure and Rights

You authorize your wireless carrier to disclose your device location information with us and other companies with whom we work in order to provide load tracking services. Your device location will be used to offer load location and ETA information to the product shipper, broker and/​or carrier for the duration of the load shipment. Your consent will be valid for the duration of the relationship or until you revoke it. You make revoke your consent by texting STOP” to 44808, by calling 312-300-7952, or by contacting your wireless carrier. Your device location information is Customer Proprietary Network Information (CPNI), which is information about your telecom­mu­ni­ca­tions service. It is your right and your carrier’s duty to protect your CPNI. Your decision will not affect your current wireless service. However, if you do not consent or you revoke consent, we are unable to use your CPNI for this purpose, this may impact project44’s ability to provide load location and ETA information.

A. Description of Service

project44 provides automated transportation and logistics solutions for freight shippers and capacity providers. Our services help connect truckload carriers to their customers to improve visibility across the entire load lifecycle. When using the Load Tracking Service, project44 will request your permission to obtain your location using your mobile phone to offer load location and ETA information to the product shipper, broker and/​or truckload carrier. You will never be located without your consent and opt-in is via a network initiated SMS opt-in process. A message will be delivered to you from the SMS short code 44808 and you must reply YES” to confirm your consent for location. The Service will attempt to obtain location data from your mobile phone during the transportation of each active load you are under contract to carry. You will receive 2 SMS messages for each load to notify you that location tracking has started and stopped. Wireless phone carriers are not liable for delayed or undelivered messages.

Important Message about your Cellular Provider (AT&T, Sprint, T-Mobile, Verizon Wireless and others). This is not a Cellular Provider application. If you use this application, it may require your Cellular Provider to disclose your customer information, including Mobile Phone Location Information, to the application provider or some other third party. By providing your consent, you authorize your Cellular Provider to disclose your information to third parties to enable this application. Check the application’s terms of use and the policies for more information about how the application will collect, access, use or disclose your information. Terms of use and other policies usually are available on the application provider’s website. If you aren’t comfortable with the application’s policies, don’t use it. You acknowledge and agree that (1) your relationship with the application provider is separate from your relationship with your Cellular Provider; (2) your Cellular Provider is not responsible for this application; and (3) you will hold harmless your Cellular Provider and its subsidiaries, affiliates, officers, employees, agents, successors and assigns from any judgments, claims, actions, losses, liabilities or expenses arising from or attributable to this application or the acts or omissions of the application provider.

Supported wireless phone carriers include AT&T, Boost, Metro PCS, Sprint, T-Mobile, U.S. Cellular, Verizon Wireless and Virgin.

SMS restrictions and account limitations: If you are attempting to opt-in to this location service and the SMS text message requesting your consent has not arrived to your phone or you received the messages, but when you attempt to reply to the message, you do not receive a response, then it is likely that your mobile phone account is configured to block text messages from Short Codes. Short Codes are non-standard phone numbers, and may also be known as Promotional Codes or Computer Generated Codes.

To fix this challenge, contact your wireless phone carrier and ask that they enable your account to receive text messages from the Short Code number 44808. Make sure to inquire how long it will take for the change to be effective so that you can try again.

B. Opting In

To opt in to share your location respond Yes to SMS opt in message. To opt out of sharing your location, respond STOP to SMS opt in message.

C. Opting Out

After you opt-in, the service will attempt to obtain location data from your mobile phone during the transportation of each active load you are under contract to carry. Verizon subscribers: You may opt out of load tracking by your mobile phone by replying STOP” to the Opt-In message received. Other subscribers, you may opt out of Load Tracking on your mobile phone by replying STOP” to the Short Code number 44808 at any time. If you opt-out of the location service, you will not be located again unless you provide your consent to be located at that time.

D. Protecting your Privacy

Your privacy is very important to us and so this Service uses only secure HTTPS communication with SSL Encryption to obtain your location data. When using this Service, your location will be used to offer load location and ETA information to the product shipper, broker and/​or truckload carrier. Location information will be captured during the transportation of the load you are under contract to carry.

Your location data, specifically latitude/​longitude information obtained via the wireless carrier will be stored for up to 72 hours after the final load delivery appointment for the purpose of concluding the shipment and any possible troubleshooting. After this, your location data will be deleted from the system.

E. Data Security

All location data is securely stored using technology and security features that safeguard the privacy of your location information, including:

  • Maintaining and protecting the security of computer storage and network equipment;
  • Security procedures that require user names and passwords to access sensitive data;
  • Applying encryption or other appropriate security controls to protect location information when stored or transmitted by us;
  • Limiting access to location information to only those with jobs requiring such access.

Although we strive to keep your location information secure, no security measures are perfect, and we cannot guarantee that your location information will never be disclosed in violation of these terms (for example, as the result of unauthorized acts by third parties that violate the law).

F. Sharing of Information

Your location data will only be shared for the purpose of providing load location and ETA information to the product shipper, broker and/​or truckload carrier associated with the load being transported. Your location data will not be shared with any other parties or used for any other purpose than its intended use (see section A for more information).

The project44 production operations team follows a security policy which prescribes a series of operational and technical controls around areas such as access control, audit logging, boundary protection, network security, personnel security, and system/​data integrity.

A number of technical and administrative controls are in place to restrict access to production customer data in our cloud environment (Amazon Web Services).

All highly restricted customer information (passwords, 3rd party credentials, location data) are encrypted at rest and all customer data is encrypted in transit using HTTPS (TLS 1.1 or above).
